INDICTMENT ‘WHITE – PAPER’ ON THE
ADMINISTRATIVE PANEL OF INQUIRY ON REPORTS OF ALLEGED
CORRUPT PRACTICES OF SOME PUBLIC OFFICERS AND OTHER PERSONS
EXECUTIVE SUMMARY
A total of 135 politicians were originally indicted in the
list compiled by
EFCC. Since that list was released, there have been arguments and
counter arguments as to whether a federal agency had the powers to bar
any candidate from participating in the electoral process.
In a bid to give legal muscle to the list, the Federal
Government
constituted an Administrative Panel of Inquiry to look into the cases in line
with Section 137(1)(i) of the Constitution.
The Section provides that: "A person shall not be qualified
for election if he
has been indicted for embezzlement or fraud by a judicial Commission of
Inquiry or an Administrative Panel of Inquiry or a Tribunal set up under the
Tribunals of Inquiry Act, a Tribunals of Inquiry Law or any other law by the
Federal or State Government which indictment has been accepted by the
Federal or State Government, respectively".
The six-man panel of inquiry constituted on
February 6, 2007 was headed
by Prof. Ignatius Ayua, the Solicitor-General of the Federation and
Permanent Secretary in the Ministry of Justice.
But only 77 cases were considered by the panel which made far
reaching
recommendations on the alleged corrupt politicians.
On
February 13, 2007, the Federal Executive Council at its meeting
approved the White-Paper and directed the Federal Government to call on
relevant security agencies to engage in further investigations in respect of
some politicians cleared by the panel for lack of evidence by EFCC.
In the 77 cases charged in the White-Paper, 22 are of the
Peoples
Democratic Party (PDP), All Nigeria Peoples Party (ANPP) 22, Action
Congress (AC) 16, Peoples Progressive Alliance (PPA) 10, while 7 had no
party affiliation.
Seventy-seven cases looked into by the panel were contained
in the White-
Paper, out of which 37 of them remain indicted as recommended by the
panel.
Thirty-six others were recommended for further
investigations, while four
politicians whose names are contained in the white paper were cleared by
the panel. The White-Paper specifically called on the Economic and
Financial Crimes Commission (EFCC) to accelerate its investigations into the
affairs of the Nigeria Ports Authority and take further actions as may be
necessary.
The White-Paper was forwarded to the Independent National
Electoral
Commission (INEC) Chairman, Prof. Maurice Iwu, and the chairmen of the
four political parties concerned.
The document was forwarded via a letter dated
February 13, 2007 and
signed by the Permanent Secretary (Cabinet Secretariat), Ambassador Joe
Keshi, on behalf of the Secretary to the Government of the Federation,
Chief Ufot Ekaette.
Those indicted are constitutionally barred from contesting the April general
elections. The list of those indicted are:
